Sommy ("Sommy," "we," "us," or "our") respects your privacy and is committed to protecting it through this Privacy Policy. This policy explains how we collect, use, disclose, and safeguard your information when you visit https://www.sommy.ai, use the Sommy mobile application (including the iOS and Android apps), or interact with any related services (collectively, the "Service").

This Privacy Policy is intended to comply with applicable privacy laws and with Google Play and Apple App Store requirements.

1. Information We Collect

1.1 Information You Provide to Us

We may collect information that you voluntarily provide, including:

  • Text queries and prompts you submit (for example, wine questions or preferences)
  • Account information (if you create an account), such as email address or authentication identifiers
  • Subscription or purchase-related information (handled via third-party payment processors)
  • Feedback, support requests, or communications you send to us
  • Photos and images you capture in the app — for example, photos of wine labels, bottles, menus, or meals you scan for recommendations and pairings.
  • Wine and taste information you build in the app — the wines you save, rate, or scan, and the taste preferences derived from your activity.

1.2 Information Collected Automatically

When you use the Service, we may automatically collect:

  • Device information (device type, operating system, app version)
  • Usage data (features used, interactions, timestamps)
  • Log data (IP address, error logs, performance metrics)
  • Approximate location (derived from IP address; not precise GPS location)

1.3 Information from Third Parties

We may receive information from third-party services, including:

  • App stores (Apple App Store, Google Play) related to downloads and subscriptions
  • Analytics providers (such as Firebase or similar tools)
  • Payment and subscription platforms (e.g., RevenueCat or equivalent services)
  • AI providers that process your queries and scanned images to generate recommendations (such as OpenAI)

2. How We Use Your Information

We use your information to:

  • Provide, operate, and improve the Sommy Service
  • Generate wine recommendations and AI-driven responses
  • Personalize your experience
  • Process subscriptions and manage entitlements
  • Monitor usage, performance, and stability
  • Detect, prevent, and address technical or security issues
  • Communicate with you about updates, changes, or support requests

Sommy does not sell your personal data.

3. AI & Data Processing

Sommy uses AI and ML models, including third-party providers such as OpenAI, to generate wine-related suggestions and responses.

  • User queries and the photos you scan (such as wine labels, menus, and meals) may be processed by AI systems, including third-party providers such as OpenAI, to identify wines and produce responses. Scanned images are stored by Sommy.
  • Queries may be temporarily stored or logged for quality, safety, and performance improvements.
  • We do not use your data to identify you personally within AI models.
  • We do not train general-purpose AI models on personally identifiable information.

AI outputs are informational and intended for guidance only. Sommy does not provide medical, legal, or professional advice.

4. Cookies and Tracking Technologies

On the website, we may use cookies or similar technologies to:

  • Maintain basic site functionality
  • Understand usage patterns
  • Improve performance and user experience

You can control cookies through your browser settings.

5. Sharing of Information

We may share information only in the following circumstances:

  • With service providers who help operate the Service (analytics, hosting, payments)
  • To comply with legal obligations or lawful requests
  • To protect the rights, safety, or security of Sommy and its users
  • In connection with a business transfer (e.g., merger, acquisition, or asset sale)

All third parties are required to handle your data in accordance with applicable privacy laws.

5.1 Wine Label Photos Shared in Our Catalog

Sommy maintains a shared catalog of wine label photos so that everyone using the app can see a picture of a wine. To build it, we use photos that users scan.

  • When you scan a wine label and we clearly recognize the wine, your photo of that label may be added to our shared wine catalog, where it can be shown to other Sommy users.
  • This is turned on by default. You can turn it off at any time in Settings ("Help build Sommy's wine label catalog").
  • Turning it off is not retroactive: it stops new photos from being shared, but any photos already added to the catalog remain in it.
  • Deleting your account does not remove photos you have already contributed to the shared catalog. Before a shared photo is kept, we remove the link between it and your account, so it remains only as a picture of a commercial wine bottle and is no longer associated with you.

6. Data Retention

We retain information only for as long as necessary to:

  • Provide the Service
  • Comply with legal obligations
  • Resolve disputes and enforce agreements

You can delete your account and associated data at any time from within the app (see Section 7). We retain data only as long as needed to operate the Service or as required by law.

7. Your Privacy Rights

Depending on your location, you may have rights including:

  • Access to your personal data
  • Correction of inaccurate information
  • Deletion of your data
  • Objection to or restriction of certain processing

You can delete your account directly in the app: go to Profile → Delete Account. This permanently removes your account and personal data, including your taste profile and preferences, your saved and scanned wines, your scan photos, your usage history, and your subscription record with our payment provider.

Two things are not deleted: (1) records of restaurant/venue visits and referrals are kept in anonymized form, with the link to your account removed; and (2) wine label photos you previously contributed to our shared catalog remain in the catalog in depersonalized form (see Section 5.1).

8. Children’s Privacy

Sommy is not intended for anyone under the age of 21 (or the minimum age required by local law). We do not knowingly collect personal data from children. If you believe we have collected such data, please contact us.

9. Security

We implement reasonable administrative, technical, and organizational safeguards to protect your information. However, no method of transmission or storage is 100% secure.

10. International Users

If you access Sommy from outside the United States, your information may be processed and stored in the United States or other jurisdictions where our service providers operate.

11. Changes to This Policy

We may update this Privacy Policy from time to time. The updated version will be indicated by a revised "Last updated" date and will be effective when posted.
